Delaware lawmakers have moved House Bill 441 forward, a proposal that would prohibit cryptocurrency kiosks across the state. If the measure becomes law, existing machines would have to stop operating immediately and be removed within 90 days.
Supporters describe the bill as a consumer-protection step, arguing that crypto ATMs have become a tool for scams and charge fees far above common online exchanges. Representative Cyndie Romer pointed to fees that can reach more than 20%, compared with the much lower range often seen on digital trading platforms.
The proposal is also tied to growing concern from law enforcement and advocacy groups. FBI data cited in the report shows more than 13,400 complaints involving cryptocurrency kiosks in 2025, with both complaint totals and reported losses rising from the prior year.
If the Senate approves the bill, Delaware would join other states that have taken aggressive action against crypto kiosks, including Tennessee, Indiana, and Minnesota. The broader trend suggests regulators are increasingly treating the machines as a fraud-risk issue rather than simply a crypto access point.
